Terms of Service

1.0 Overview

This agreement outlines the relationship between the Customer and Thundranode AS regarding the purchase or rental of services provided by Thundranode AS. The agreement is considered effective once the Customer submits an order, which can be done via phone, web, email, or in person.

2.0 Parties Involved

3.0 Contact Information

The Seller assumes that the designated email recipient and those with account passwords have the authority to manage associated products and services. This authority encompasses modifications, deletions, relocations, cancellations, or other actions that may affect the services. The Customer must maintain proper routines to ensure correct handling of rights related to products and services and notify the Seller of any changes in control information.

The Customer is responsible for updating the control panel with changes related to ownership, contact details, or any other relevant information. If access to the control panel is unavailable for any reason, the Customer must inform the Seller of these changes directly. It is the Customer's responsibility to ensure the information provided to the Seller remains current and accurate.

4.0 Payment Terms

The Seller is entitled to request payment for the services once the Customer places an order. If payment is made via credit or debit card, the Seller may temporarily hold the purchase amount at the time of the order. The card will be charged when the service is delivered. The Customer may opt to pay using Stripe or Paypal.

5.0 Delivery of Services

Services are considered delivered when the Customer or their designated representative gains access. If delivery times are not specified in the order, the Seller will provide the service without unnecessary delays and within 30 days from the order date. Services will be delivered to the Customer unless otherwise agreed upon.

6.0 Termination of Services

The Customer is responsible for retrieving all data from the Seller before the expiration of the Agreement Period if they intend to terminate or relocate services. All Customer data will be deleted upon service termination, whether the termination occurs at the end of the Agreement Period, upon receipt of notice, or on a specified service discontinuation date. If termination is executed improperly, it will be at the Seller's discretion to accept it.

The Seller reserves the right to terminate any agreements or decline orders. Customers can log into their account and select the service to discontinue, choosing whether the termination takes effect immediately or at the next billing cycle. All recurring payments will conclude upon termination.

7.0 Breach of Agreement

If the Customer significantly fails to meet their obligations to the Seller, the Seller has the right to terminate the agreement(s) immediately, resulting in service cessation and data deletion without prior notice. A significant breach includes failure to make payment more than 14 days past the due date. In such cases, the Seller may restrict the Customer's access to services. The Customer assumes the risk if one service's breach impacts another's functionality. Payment obligations remain in effect for the entire agreement period even after a breach.

8.0 Modifications to Terms

The Seller reserves the right to update, upgrade, or modify products and services at any time. The Seller may adjust prices and terms related to services without prior notice. Adjustments may occur in response to changes in market conditions, such as currency fluctuations or adjustments in supplier prices.

Substantial changes to terms will be communicated to the Customer with a minimum of 14 days' notice via email or through the control panel login. Should the Customer disagree with substantial changes, they must terminate the services within 14 days of notification; otherwise, the changes will be deemed accepted.

9.0 Late Payments

In the event of late payment, a fee of 10 Norwegian kroner will be applied per day following the due date. Services tied to overdue invoices may be temporarily suspended until full payment is received, including any applicable late fees. If payment is not made within 7 days after the original due date, services may be permanently deleted.

10.0 Right to Withdraw

If the Customer has not used the service, such as not starting a game server, they have 14 days to invoke their right of withdrawal. Additionally, all new customers are eligible for a 7-day open purchase period, allowing for a full refund if they withdraw within that time. Each customer can utilize this option only once. Dedicated IPs, Modpack Installations, and Proxy Setups are considered customized services and are exempt from the right of withdrawal once delivered.

11.0 Service Defects - Customer Rights and Complaints

Complaints should be submitted in writing. The Customer may opt for repairs or replacements; however, the Seller may resist if fulfilling the request is impossible or would incur unreasonable costs. Repairs or replacements will be carried out within a reasonable timeframe, with a limit of two attempts for the same defect.

The Customer can request a price reduction if the service is not adequately repaired or replaced, reflecting the difference in value between the defective and conforming items. Rescission is an option if the defect is not minor.

12.0 Conflict Resolution

Complaints must be directed to the Seller within a reasonable timeframe. The parties will endeavor to resolve disputes amicably. If an agreement cannot be reached, the Customer may contact the Consumer Council for mediation at 23 400 500 or through www.forbrukerradet.no. The European Commission's complaint portal is also an option, particularly for consumers residing in another EU country, available at https://ec.europa.eu/odr.

Agreement Terms for Minecraft Server

1.1 Overview

This agreement governs the relationship between the Seller and the Customer regarding the Minecraft Server.

Any terms not defined herein fall under the general terms of agreement, named "General Terms of Agreement." Specific terms deviating from these general terms take precedence.

2.1 Uptime Guarantee

The infrastructure, such as panel and server, is guaranteed to have a 99.99% uptime. If this uptime is not met, the Customer will receive a discount equivalent to 1 day per hour of downtime, with a maximum compensation of 1 month of free service. The Customer must inform the Seller if they believe the uptime guarantee has not been fulfilled. Planned maintenance is not included in downtime calculations.

3.1 Subscription

The Minecraft Server is an ongoing subscription billed in advance. If the Customer cancels after the start of a new billing period, they are responsible for the full period's payment. The payment obligation aligns with the billing period initiated.

4.1 Miscellaneous

The Customer is responsible for managing their server operations, holding administrator access, while the Seller does not oversee this management. The Customer must monitor all relevant server aspects.

If the Customer's actions cause issues affecting others, the Seller may suspend the service or ask the Customer to stop problematic software usage.

Agreement Terms for Dedicated Server

1.2 Overview

This agreement outlines the relationship between the Seller and the Customer regarding the Dedicated Server.

Terms not specifically defined here follow the general terms of agreement defined as "General Terms of Agreement." Specific terms take precedence over general terms.

2.2 Uptime Guarantee

The Dedicated Server infrastructure is guaranteed to have 99.99% uptime. If this is not met, the Customer receives an equivalent discount for 1 day per hour of downtime, with a maximum of 1 month of free service. Customers must alert the Seller regarding unmet uptime guarantees, while scheduled maintenance is excluded from downtime counts.

3.2 Subscription

The Dedicated Server is an ongoing subscription that bills in advance. If the Customer cancels after a new billing cycle begins, they are responsible for the full payment of that initiated billing cycle.

4.2 Miscellaneous

The Customer manages their own server operations, holding root/administrator access, while the Seller does not engage in management. If the Customer's services disrupt others, the Seller may suspend the user's service or request the cessation of problematic software.

The Customer must ensure compliance with all applicable laws and regulations, taking responsibility for all material placed on the server. The Seller does not tolerate activities violating copyright or laws.

If the Customer has ordered management, the Seller manages everything without granting root/administrator access. Management includes essential server updates, backups, monitoring, and performance assurance. If uptime does not reach 99.9% in a given month, the Customer pays nothing, but must directly notify the Seller of any unmet guarantees.

5.2 Right to Withdraw

The Dedicated Server is customized upon order; thus, there is no right of withdrawal after delivery. The Customer acknowledges this waiver upon ordering.

Agreement Terms for Counter-Strike: Global Offensive Server

1.3 Overview

This agreement governs the relationship between the Seller and the Customer concerning the Counter-Strike: Global Offensive Server.

Any undefined terms here revert to the general terms of agreement, "General Terms of Agreement." Specific terms will take precedence when differing.

2.3 Uptime Guarantee

The infrastructure guarantees 99.99% uptime. If unmet, the Customer gets a discount of 1 day for every hour of downtime, capped at 1 month of free service. The Customer must report any failures to the Seller, remembering that scheduled maintenance is excluded from downtime.

3.3 Subscription

The Counter-Strike: Global Offensive Server operates as a subscription billed in advance. Customers are accountable for any payments if cancellation occurs after the new billing cycle begins.

4.3 Miscellaneous

This service requires the Customer to manage their server activities with administrator access, while the Seller does not intervene. If issues arise due to the Customer’s services, the Seller may suspend access or request the discontinuation of troublesome software.

Agreement Terms for Rust Server

1.4 Overview

This agreement outlines the relationship between the Seller and the Customer concerning the Rust Server.

Terms not defined revert to the general agreement terms titled "General Terms of Agreement," wherein specific terms take precedence.

2.4 Uptime Guarantee

This server guarantees infrastructure uptime of 99.99%. Should that not be met, a discount of 1 day for each hour of downtime will be granted, with a maximum of 1 month of free service. Any non-fulfillment must be reported to the Seller, and scheduled maintenance is excluded from downtime calculations.

3.4 Subscription

The Rust Server follows ongoing subscription billing in advance. If cancellation occurs after a new billing cycle starts, the Customer must cover the total costs associated with that period.

4.4 Miscellaneous

Customers maintain server operations with administrator privileges while the Seller does not manage the service. If the Customer causes disruptions impacting other users, the Seller retains the right to suspend service or request cessation of problematic software.

Agreement Terms for Unturned Server

1.5 Overview

This agreement governs the relationship between the Seller and the Customer in relation to the Unturned Server.

Undefined terms will follow those in the general terms of agreement named "General Terms of Agreement" while specific terms will have precedence.

2.5 Uptime Guarantee

The Unturned Server promises 99.99% uptime. If this is not met, the Customer is entitled to a discount of 1 day for every hour of downtime, with a limit of 1 month's free service. The Customer needs to contact the Seller if they suspect the uptime guarantee isn’t being honored. Planned maintenance does not count as downtime.

3.5 Subscription

The Unturned Server is billed in advance as an ongoing subscription. If the Customer chooses to cancel post the commencement of a new billing period, they must be accountable for the complete amount for that period.

4.5 Miscellaneous

This service requires the Customer to oversee their server operations and provides administrator access. The Seller does not manage the server but the Customer is responsible for monitoring all operations. Issues caused by the Customer's services affecting others may lead to service suspension or requests to halt disruptive software.

Agreement Terms for Discord Bot Server

1.6 Overview

This agreement establishes the relationship between the Seller and the Customer regarding Discord Bot Server services.

Any terms not explicitly defined will default to the general agreement terms known as "General Terms of Agreement," with specific terms taking priority.

2.6 Uptime Guarantee

Infrastructure for the Discord Bot Server guarantees 99.99% uptime. If not achieved, the Customer receives 1 day of discount for each hour of downtime, capped at 1 free month. Customers must report unmet guarantees while scheduled maintenance is exempt from downtime calculations.

3.6 Subscription

This server operates as a prepaid ongoing subscription. Cancellation within a current billing cycle requires the Customer to pay for the entire initiated billing period.

4.6 Miscellaneous

The operation of the Discord Bot Server is solely managed by the Customer with administrator access. The Seller does not oversee the server. The Customer assumes responsibility for all monitoring and management activities. In case of service disruptions affecting others, the Seller reserves the right to suspend services or ask the Customer to cease any problematic usage.

Agreement Terms for Custom Minecraft Plugin

1.7 Overview

This agreement details the relationship between the Seller and the Customer related to Custom Minecraft Plugins.

Terms not specifically defined fall under the general agreement terms referred to as "General Terms of Agreement," where specific terms hold precedence over general ones.

2.7 Miscellaneous

Plugins are made to order for the Customer, who will submit a detailed request to the "Custom Minecraft Plugin" department outlining the desired functionality.

3.7 Right to Withdraw

The Custom Minecraft Plugin is recognized as a bespoke service, and therefore, there is no right of withdrawal once the order has been fulfilled. The Customer acknowledges and accepts the waiver of the right of withdrawal upon the placement of the order.
